Michigan Court Ruling Leaves Paid Sick Leave Law Unchanged

A recent decision by the Michigan Court of Appeals overturned a 2022 Court of Claims ruling that struck down the Michigan wage and paid sick leave law enacted in 2018. The ruling was struck down due to improper amendments of two voter ballot initiatives related to those issues in violation of the Michigan Constitution.

With the ruling, the Paid Medical Leave Act reverts back to the version of the law that excluded temporary employees from the paid sick leave mandate. The decision has been confirmed through thorough due diligence by the American Staffing Association and the Michigan Department of Labor and Economic Opportunity and the predecessor agency.

The ruling is effective immediately, meaning Michigan staffing firms are not required to make any changes to their paid time off policies.
